Birth Injury
A birth injury can be suffered
during the birthing process, most often occurring when the baby is passing
through the birth canal. Birth injuries can range from minor cuts and bruises
to life debilitating problems. While some birth injury accidents are unavoidable,
some injuries can be sustained because of negligent medical treatment. Many
newborns will suffer minor birth injury swelling or bruising in certain
areas because of the natural birthing process.
A more common birth injury occurrence can include head injuries such as
swelling of the baby's scalp as it travels through the birth canal. Sometimes
an area of bleeding underneath one of the cranial bones will occur, which
will not need treatment and will disappear within weeks or months. More
severe, a head birth injury that results in a fracture of the baby's skull
will sometimes heal on its own unless a depressed fracture is present.
Difficult births or the delivery of larger babies will sometimes require
the aid of forceps. Forceps can cause bruising and other marks on the baby's
face and head that will usually be temporary. Improper use of the forceps
can result in more serious bruising. Pressure on the baby's face because
of the use of forceps can cause a birth injury like facial paralysis.
A facial paralysis birth injury is often the most noticeable when the baby
cries because there is no movement on the side of the face that is affected
by the injury and the baby's eyes are unable to close. If the nerve in the
face was torn because of the birth injury, surgery may be necessary to repair
it. When the nerve has just been bruised the facial paralysis will normally
show healing within a few weeks.
Brachial palsy is a birth injury that affects the nerves that control movement
of the arms and hands. The severity of a brachial palsy injury can vary
depending on how severe the brachial plexus has been impacted. A birth with
shoulder dystocia, or larger than average sized shoulders can be difficult.
In order to deliver the baby, the brachial plexus may become bruised, swollen,
or suffer complete tearing of the nerves. The majority of babies will recover
from the brachial plexus birth injury but some babies will sustain permanent
nerve damage.
Treating more severe cases of brachial plexus palsy birth injuries can
require surgical procedures if no functional recovery has been witnessed
by a few months of age. Since nerve surgery beyond one year old will not
be able to repair functioning, it is important to determine if birth injury
treatment methods can help with recovery as early as possible. In most instances,
the younger the child is the quicker recovery there will be.
Not every birth injury will be considered negligence or malpractice but with
the advances in technology doctors are better able to determine if risk factors
for birth injuries are present. The difficulties a birth injury can create
for a family is more than just physical, as emotional and financial struggles
can also be present. If malpractice has contributed to the birth injury, a
birth injury lawyer can help recover damages and better ensure the best medical
treatment for the baby is accessible. For more information on birth injury,
